These terms and conditions relate to FEA Create only. If you’d like to join our membership or purchase any of our other products then please click here to see the terms which apply. Our terms and conditions are very similar but in order to make it really clear we have split out the terms for FEA Create so that you can see exactly what applies to purchase.

The following terminology applies to these Terms and Conditions: “Customer”, “Subscriber”, “User” “You” and “Your” refers to you, the person accessing this website and you as a purchaser. “The Company”, “Ourselves”, , “We” and “Us”, refers to the Company, Carrie & Co Ltd, a UK limited company registered under company number 09285984 with registered office at 29a Alderley Road, Wilmslow, SK9 1HY. “FEA Create” refers to our all in one platform.

It’s important to us that you are completely clear from the outset the way in which we will deliver our products and services to you. If you are planning to make a purchase then you must read these terms and conditions in full.

If you require any assistance and wish to ask about product and service specifications or suitability, then please do not hesitate to get in touch with us by email prior to purchasing, so that we can support you prior, as on purchase you will be bound by these terms in full without variation.

FEA Create

What is it?

FEA is our all-in-one digital platform, designed to bring the multiple platforms that many entrepreneurs use, into one space. FEA Create provides marketing tools, services and software all through one platform. Our aim is that by bringing the systems that you need into one place you’ll be more efficient with your time and money and you’ll have the tools that you need to grow a successful business, all under one roof.

What do you get?

When you subscribe to FEA Create, you’ll get instant access to a range of business tools which will support you to:

* Build a website to advertise your products and services, including hosting a blog and images, videos and PDFs;

* Sell your services, including one-off sessions (power hours), digital products, courses, and memberships;

* Create opt-in pages, for freebies and grow your email list;

* Sell your products and utilise checkout page templates and add upsells and order bumps;

* Manage and track leads with all of your DMs and client communications in place;

* Manage client contracts and payments and send invoices

Fees & Payment

You can join FEA Create via a monthly or annual paid subscription.

When purchasing a subscription for FEA Create you agree to pay us for use of the product in accordance with the pricing and payment terms detailed on our website. Payments will be taken as stipulated in the description e.g. a one-time, one-off payment, or a monthly or annual subscription payment.

Where you are subscribed to a monthly or annual subscription your subscription shall renew at the same time each billing cycle (whether monthly or annually). For monthly subscribers, every month thereafter on the same date each month. Annual subscribers are charged on the same date each year. You are required to ensure that your payment method stays up-to-date. We may terminate your subscription and remove you from all our Female Entrepreneur Association and Carrie & Co. platforms if your payment fails and we are unable to contact you to collect this.

If we are unable to process your subscription payment successfully, our system will usually retry every 3 days using the existing payment method you added. We reserve the right to manually retry this payment(s) at any time on your existing payment method – or any new payment methods that you add to your account – to process any outstanding debts.

The Female Entrepreneur Association is not liable for any late payment fees or reclaimed failed payments by PayPal. It is your responsibility to ensure your bank card details are correct and up to date, to do this you can follow the steps on the PayPal site here. Should you fail to keep your payment information up-to-date, your subscription may be cancelled. We are under no obligation to renew your subscription, or renew it at your previous rate, if it is cancelled as a result of prior non-payment.

In instances where your account has been suspended or an account falls overdue, any scheduled email marketing may be paused until all sums are paid. FEA takes no responsibility for any consequences of your account suspension where your payment information has not been properly maintained.

In order to regain access to your account you will be required to settle any outstanding balance associated with the payment on your account in order to gain access. If payment is not made promptly, we reserve the right to terminate your account which will result in the loss of your client data and information. At all times you remain responsible for ensuring that you have a paid subscription in place. Where a subscription is not properly paid the services will be paused which means that automations and emails will not be sent, including emails pre-scheduled.

We reserve the right to change the price for your subscription and or the features included within the subscription. Prior to changing the price or any features, we shall notify you by email. If you do not wish to accept the price change you must cancel your subscription prior to the price change taking effect. If you do not cancel your subscription then you will be taken to have accepted the price change.

Each payment refers to one subscription, if you are an agent or work with multiple clients you will require additional subscriptions.

The Female Entrepreneur Association does not accept payment in the form of cheques. Consequently, all purchases and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

Cancellation Policy and Refunds Policy

We want and expect you to be completely happy with your purchase. If for any reason you have any concerns or cause for complaint, please contact us immediately via email [email protected] so that we can provide additional support and guidance.

It is important that you are aware that any assets that you upload and create within FEA Create are not transferable to any other third party site or platform and that you cannot export your funnels, webpages, workflows or any other design features. Should you wish to cancel your subscription, you will need to ensure that you have copies of all necessary material before your subscription cancels.

Trial Subscription:

If you sign up for a free trial or discounted period, and you do not cancel your subscription prior to the end of the free trial period, then you will be charged for a full price subscription on the day after the trial ends. We will remind you that your trial is due to end and charges will apply. At the end of a trial period, charges will apply automatically and will continue until cancelled.

You may cancel your trial subscription at any time by emailing our support team at [email protected], giving 3 DAYS NOTICE to cancel your account.

You must close your subscription before your renewal date in order to prevent any charges on your account. FEA does not offer refunds if the account is not closed in time. You can cancel your subscription by clicking on your profile icon & ‘cancel subscription’.

Please note that we do not offer the option to pause your subscription. Should you fail to pay your subscription fees when they fall due they will be deemed paid late and your account will be suspended until all outstanding fees are paid.

If you do decide to cancel your subscription at any point, you will still have access to FEA Create until the end of the current billing cycle, following which your access to your access will be revoked. You must ensure that you have copies of any content, including text and images which have been formatted into sales pages or funnels, as once your access has been cancelled you will not be able to gain access to view the platform. Once your subscription has been cancelled all emails and automations which you have built will be stopped.

Should you cancel your subscription with the FEA Create, it is your responsibility to ensure your recurring payment is cancelled with PayPal directly to save any future payments being taken by PayPal, you can do this with PayPal here.

Please make yourself aware of PayPal’s Privacy Policy if this is your chosen payment gateway for your subscription.

Standard Subscription:

You may cancel your monthly subscription at any time by emailing our support team on [email protected] giving 7 DAYS NOTICE to cancel your account.

As a new subscriber, you may cancel your monthly subscription and request a full refund within your first 14 days of joining the platform for the first time on a monthly subscription only; this is our money-back guarantee. This excludes new subscribers joining on an annual subscription.

Outside of your first 14 days, we don’t offer refunds, but you can still cancel your monthly subscription at any time.

Existing or returning subscribers, who have joined again, may cancel their subscription via the same methods as mentioned above, however, payment will not be eligible for a refund, you will continue to have access to the platform until your cancellation takes effect on the day or so before your next billing date.

For annual subscriptions, you may cancel your subscription at any time, meaning it will not renew after the initial 12 months.

We do not offer partial refunds or assignments on annual subscriptions should you decide that you no longer wish to use the platform.

If you have signed up to the monthly subscription and would like to switch to an annual subscription, our team will be happy to help transfer this for you. Please allow at least 3 days prior to your monthly billing date for us to process the change from a monthly to annual subscription in time. Switching from an annual subscription to monthly subscription is not possible during your first 12 months, however if at the end of your 12 month subscription you would prefer to pay monthly instead, our team can happily help you with this.

14-Day Money Back Guarantee

This guarantee applies for both monthly and annual subscriptions. We understand that you will want to take a look at the platform and ensure that it will be a good fit for your business. Should you change your mind within the first 14 days following your purchase you can cancel your subscription and get a full refund, as long as you haven’t begun to receive customised support. We are committed and invested in the success of your business when you are using our platform, from the moment you obtain bespoke support and start customising and building out FEA Create with our support, you will no longer be eligible for a refund if you change your mind. You can still cancel before 14 days, but you will not receive a refund.

Should you wish to cancel your subscription after the first 14 days, you may do so at any time. Please email us [email protected] to request cancellation and we will support you to cancel your subscription from the next billing cycle. Following the first 14 days, should you change your mind and wish to end your subscription, all payments are non-refundable, including any unused portion of your subscription.

Intellectual Property and Ownership

All training materials within the platform will always remain the property of Carrie & Co. and are not to be reproduced or distributed. You have the right to use the materials as learning tools but you are not permitted to duplicate or provide copies to third parties. We retain and reserve all of our copyrights.

Further, you are not permitted to use the trainings within the platform to teach or train others, or to use our platform, style or materials to create your own similar services.

You retain ownership of all content which you add to FEA Create. “Content” means: images, videos, text copy, audio files, data, email addresses, telephone numbers, information, layouts and design. FEA Create does not claim any ownership rights over your Content. At all times you are responsible for checking and maintaining your content, pages, links and functionality.

In uploading Content to FEA Create, you are agreeing to allow us permission to make copies of and store your Content. You understand that at all times you should hold original copies of your Content and we are in no way responsible for the storage and have no liability whatsoever for any damage, loss or destruction of Content.

You accept and acknowledge that any assets that you upload and create within FEA Create are not transferable to any other third party site or platform and that you cannot export your funnels, webpages, workflows or any other design features.

Whilst we do not claim any rights over your Content, we require that you have all of the necessary rights and permissions to use the Content within the site. Including where necessary adequate licensing agreements.

We take brand protection seriously. Should we be contacted by a third party with a takedown notice we may suspend your account or parts of it, whilst the circumstances are investigated. At all times we will act in accordance with the direction of relevant government authorities in respect of any allegations connected to your Content.

You should be aware that whilst we claim no ownership rights of assets that you have created we also cannot guarantee any ownership or intellectual property rights for anything that you create using our site. Our site utilises templates and pre-prepared automations which other users will also have access to and therefore we do not guarantee that you will access unique assets.

FEA Create is a technical platform not an educational course or forum. We do not review, approve or pre-screen Content for any reason. We are not responsible to you or any regulatory body for any element of your offering under no circumstances will we approve or check your Content. We do not accept or assume any responsibility to you to monitor your Content for inappropriate or unlawful content and we assume no responsibility for any Content which you share.

Notwithstanding the lack of obligation on us to monitor your Content, should we be alerted to any misuse or inappropriate Content being shared by you, we may act to remove or delete any Content at any time.

Confidentiality

We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

Disclaimers, exclusions and limitations of liability

The aim of FEA Create is to provide you with a centralised system and the necessary tech tools which you need to create and run your business. As a business owner, your business is individual and personal to you and whilst the strategies and techniques which we will provide are tested, it is not intended that you will watch a video or read a workbook and that you will instantly create a landing page and then sell out your offer overnight.

We reserve the right to provide our products and services to any customers of our choice. Such customers may represent a competitor in your chosen field or industry and we offer no exclusivity as to access or any liability to you in connection with the use of our platform by your competitors.

We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

We make no guarantees or claims as to the success of any user. Each individual is unique and their business and processes are unique to them. The aim is that by working through the training material and resources and taking advantage of all of the elements which the platform has to offer, you will have new information, strategies and techniques to create a successful business.

From time to time, we will share testimonials and success stories. Not all platform users will be able to get their website live in a short period of time. Not all platform users achieve the same level of revenue success; some users will not generate any revenue. We cannot guarantee any specific level of success or income. You should not rely on any results shared or any testimonials as an indication of what success you may create.

All information provided will be general information and guidance and will not be bespoke advice. We are not responsible for any action or inaction which you take as a result of the information within the platform. We are not responsible for any loss of opportunity or any investments which you make.

We are not responsible for any commercial agreements between you and your customers. We do not monitor your service deliverability and have no responsibility to you in this regard.

No content within FEA Create shall be construed as financial or legal advice. Should you need financial or legal support you should seek advice from a professional based in your jurisdiction.

In using our services you will be required to create an account and login details. The email address you select for your login should be kept up-to-date and accurate along with all other information you provide to us. You are responsible for the safety of this information and should keep your password private. You are not permitted to share your login information with third parties to utilise the products or services you have purchased from us. We reserve the right to suspend or terminate your use of our services and to take legal action should any of our terms be breached.

To the extent permitted by law, the total liability we may owe to you in connection with or arising out of your use of our Products and these terms shall not exceed the total amount you have paid to use any of our Products.

From time to time, we may provide training and resources from third-party experts. Whilst these experts are carefully selected, we provide no guarantees or representation that the information that third-party experts provide is accurate.

Should you wish to work with an expert whom you are introduced to via the platform, then you do so at your own risk and you should complete your own due diligence. We provide no representations or warranties in respect of any experts. Should there be a referral or commission agreement in place with any experts that will be transparently disclosed.

The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, we:

* exclude all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature;

* exclude all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

We do not exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

Conduct of Users

It is requested that at all times your behaviour towards others is polite and respectful. We will not be held responsible for the behaviour or actions of any other platform users. Should your behaviour be deemed offensive or inappropriate, we reserve the right to remove you from the platform and/or support channels with immediate effect.

We ask that all subscribers respect the rights of others in respect of their behaviour and privacy. We will not be responsible for the actions of any subscribers , including for any disclosures made by any other based on information which has been shared within the group sessions or the support group.

Privacy & Security

When using our platform you agree to do so in accordance with applicable data protection legislation. You are responsible for ensuring that your client’s data is protected in accordance with data protection, security and privacy legislation which may apply differently to different users depending on where they reside. This includes the requirement to ensure that you have valid consent on behalf of your clients for any data storage, including the use of special category data and including the use of cookies or similar technologies. Where required, you must ensure that you have a privacy policy and cookies policy which is compliant with the necessary laws and regulations.

We confirm that we have the necessary systems, policies and procedures in order to protect your Content and unauthorised access or use.

Management & maintenance, changes and updates

We are committed to delivering the highest level of service and therefore our services are subject to change. We make no guarantees as to the availability of any functionality within FEA Create. Where we plan to remove access to part of a product or service we will, where possible, provide advance notice. However, we retain the right to alter and amend our subscriptions at any time as required.

From time to time, we will have to maintain and upgrade our system. During those periods we will provide as much notice as possible and aim to limit any downtime to only that which is strictly necessary. Where possible we shall provide you with advanced notice of technical downtime. We shall not be liable to you for any losses during periods of planned or unplanned downtime.

General

We intend to rely on the written terms set out in these terms and conditions for the services that we provide to you in the delivery of the platform. These written terms shall constitute the entire agreement between us.

Should there be any conflict between these terms and any payment gateway, these terms shall prevail.

We may update these terms and conditions from time to time for legal or regulatory reasons or to allow the proper operation of your service. Any changes will be notified to you as soon as possible.

If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of these terms and conditions.

In the event of a dispute, both parties agree to attempt to resolve the issue through negotiation and, if unsuccessful, where appropriate, through mediation before resorting to litigation. There is no requirement to mediate but this should be considered by the parties before litigation is initiated.

These Terms are governed by the laws of England & Wales. The Courts of England & Wales have exclusive jurisdiction for any matter and proceedings arising out of the use of the platform.
